These SMS/RCS Messaging Terms of Service ("Terms") govern the text messaging services (SMS and Rich Communication Services, together "Messaging Services") provided by CyberSpark Solutions, LLC ("CyberSpark," "we," "us," or "our") to you ("you" or "Recipient"). By opting in to receive text messages from us, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not opt in, or opt out by following the instructions below.
By providing your mobile phone number to CyberSpark Solutions — through our website, ticketing system, helpdesk portal, service agreements, or by text — you expressly consent to receive automated SMS and RCS messages from us regarding:
Consent to receive messages is not a condition of purchasing any goods or services. You may withdraw consent at any time (see Section 4).
Messages are sent in response to your requests or in connection with your active services and support tickets. Message frequency varies depending on your service activity — for example, you may receive several messages during an active support incident. We do not send marketing text messages without your separate express consent.
To stop receiving messages at any time, reply "STOP" to any message. You may also opt out by emailing ryan@cybersparksolutions.com or calling (631) 246-0707. Upon opt-out, you may receive one final message confirming your opt-out. After that, you will receive no further messages unless you re-subscribe by providing consent again. Note that opting out of messaging does not cancel service-critical notices delivered by other channels (email, phone, or portal) under your service agreement.

We do not charge a fee for you to receive our messages. However, message and data rates may apply based on your wireless plan. Charges are billed by and payable to your mobile carrier. Delivery of SMS/RCS messages depends on factors outside our control, including your carrier's network, coverage, capacity, equipment, and RCS availability. Carriers do not guarantee delivery, and we are not liable for delayed or undelivered messages.
Rich Communication Services (RCS) messages may include rich content (images, buttons, verification branding, and similar features) and may be delivered over your carrier's RCS infrastructure or messaging apps. Availability of RCS features depends on your device, carrier, and messaging application. If RCS is unavailable, messages may be delivered as standard SMS. RCS features may be provided in part by your carrier or platform provider (such as Google), and their terms also govern your use of those features.
In connection with our Messaging Services we may collect your mobile phone number, mobile carrier, message content you send us, and the date/time of messages. We use this information solely to provide and support the services you requested. See our Privacy Policy for details on how we handle your information.
Our Messaging Services are not intended for emergency communications. Do not rely on SMS/RCS to report emergencies. For urgent issues, call (631) 246-0707. Never use our messaging services to request emergency assistance — call 911 for emergencies.
You agree not to use our Messaging Services to transmit unlawful, harassing, abusive, or spam content, or in any way that interferes with our systems or violates applicable law (including the Telephone Consumer Protection Act and CAN-SPAM Act).
We may update these Terms from time to time. Material changes will be posted on this page with a revised effective date, and where required we will notify you before changes take effect. Continued receipt of messages after changes become effective constitutes acceptance of the revised Terms.
